All capitalized terms used in this document („Privacy Policy”) shall have the meaning given to them in the Terms and Conditions, unless otherwise indicated.

This Privacy Policy applies to the Services, as well as to the linkfloat.com website and application owned by Dominik Ostrowski.

The Privacy Policy describes how we collect, use and disclose personal information about Users, Customers and visitors to the Website and Application (collectively - „you” or „your”). The Privacy Policy also contains information about cookies and similar technologies used on the Website and Application.

Please note that this Privacy Policy applies to information provided by you or a Customer through the Website, Application, including, for example, by registering for an Account or contacting us.

For purposes of this Privacy Policy, unless otherwise required by applicable law, „personal data” means any information that identifies, relates to, describes, or is reasonably capable of being associated, linked or linkable with a particular individual or household, including any information that is subject to applicable data protection laws.

Your personal data is processed by the Controller in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC („GDPR”).

What are your rights?

In connection with our processing of your personal data, you have the right to request from us:
  1. access to your personal data, including a copy of your data;
  2. to have your data rectified in the event that your data is untrue or incomplete;
  3. to delete your data in the event that:
    • data is no longer necessary for the purposes for which it was collected by us; or
    • data is processed unlawfully; or
    • you object to the processing of data; or
    • data should be deleted in order to comply with a legal obligation;
  4. limitation of data processing in case in which:
    • the correctness of the data is questioned - for a period of time allowing us to verify the correctness of your data; or
    • data is processed unlawfully, but you do not want data to be deleted; or
    • your data is no longer needed by us, but may be needed by you to assert or defend claims; or
    • in case in which you raise an objection to data processing - until it is determined whether our legitimate interests override the grounds for the objection;
  5. to transfer your data to another controller in the event that data is processed by automated means in connection with a contract concluded or consent given.

In addition to the above-mentioned rights, you also have the right to object to the processing of your personal data to the extent that the processing is based on our legitimate interest and the objection is justified by your particular situation, unless we process data on the basis of legitimate interest for marketing purposes, in which case we must always consider your objection and you do not have to give us any justification.

Where we process personal data on the basis of your consent, you have the right to withdraw it at any time, with effect for the future. Withdrawal of consent does not affect the lawfulness of processing that took place on the basis of consent before its withdrawal.

If you wish to exercise your rights indicated above, or if you believe that our processing of your personal data violates applicable law, please contact us at the addresses indicated above in the Privacy Policy. As a rule, we do not charge a fee for exercising your rights. However, if the request is clearly unreasonable, repetitive or excessive, we may legally charge a reasonable fee or refuse to comply with the request.

If you believe that our processing of your personal data violates applicable law, you also have the right to file a complaint with the supervisory authority which is the Polish President of the Office for Personal Data Protection (Stawki Street 2, 00-193 Warsaw, Poland; https://uodo.gov.pl/en/681/1404).

What data we collect about you?

We receive your personal data directly or indirectly from you, especially when you use our Services or visit our Website or Application, or enter into a contract with us.

If you represent the Company we receive your data directly from you or via the Representative (i.e., the person representing your employer or the organization you are related to). When you register an Account for the use of our Services, you provide your e-mail address and password. Providing this data is necessary to register an Account. As part of your Account, you can also add documents containing personal data, which we will also process in the event.

You can use both Non-Paid and Paid Services provided by the Service Provider.

To place Orders it is also necessary to provide payment card details. We may also process your purchase records and information about your use of the Services.

If you agree, we will send you Newsletter, display or send you Notifications to the email address you have indicated.

If you choose to contact us, you will also share some personal data with us from a message sent via the contact form, email or traditional correspondence. If you choose to make a complaint about your use of the Services provided by the Service Provider or the processing of your personal data, we may process your personal data contained in the complaint for the purpose of investigating the complaint, in particular your contact details (name, surname, postal address or email address).

From the information recorded on the server, it will be possible to read in real time what browser and operating system you are using and the IP address associated with your device, your device ID, cookies installed on your device, date/time stamp, referring/exit pages, pages clicked on, actions you take on the Website or the Application, and any other information your browser or device may send us. If you consent to our use of cookies or similar technologies other than those strictly necessary for the use of the Website, Application and Services, we process your personal data about your activity on the Website or Application for analytical, statistical or advertising purposes, depending on which cookies you have consented to.

For what purposes we process your personal data?

We may process your personal data we collect for the following purposes:
  1. to contact you in connection with your inquiries about our Services, i.e. to take steps at your request before concluding an agreement with you (the legal basis is Article 6(1)(b) GDPR); if you are the Company's Representative or Employee, contact with you in the above mentioned matters constitutes our legitimate interest (the legal basis is Article 6(1)(f) GDPR);
  2. in order to provide you our Services, process your payment for Paid Services and facilitate billing communication, send you notifications related to your use of the Services, i.e. to conclude and perform a Services Agreements concluded with you (the legal basis is Article 6(1)(b) GDPR); if you are the Company's Representative or Employee, processing your personal data for the above mentioned purposes constitutes our legitimate interest (the legal basis is Article 6(1)(f) GDPR);
  3. to provide, support, personalize, and develop our Website, Application and Services by learning about your preferences and general trends relating to the Services, which constitute our legitimate interest according to Article 6(1)(f) GDPR;
  4. to help maintain the safety, security, and integrity of our Services, databases and other technology assets and businesses, which constitute our legitimate interest according to Article 6(1)(f) GDPR;
  5. to respond to law enforcement requests as required by applicable law, court order, or governmental regulations, i.e. to fulfill our legal obligations (the legal basis is Article 6(1)(c) GDPR in relation to specific provisions of law);
  6. for the purpose of service billing and accounting and the performance of related legal obligations imposed on us (the legal basis is Article 6(1)(c) GDPR in relation to specific provisions of law);
  7. to provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses, which constitute our legitimate interest according to Article 6(1)(f) GDPR;
  8. to process complaints or your requests concerning processing of your personal data which constitutes our legal obligations according to Article 6(1)(c) GDPR in relation to specific provisions of law;
  9. to establish and assert or defend against claims, which constitute our legitimate interest according to Article 6(1)(f) GDPR;
  10. for analytical and statistical purposes which constitutes our legitimate interest according to Article 6(1)(f) GDPR;
  11. to send you Notifications and Newsletter electronically, if you have previously agreed to it (the legal basis is Article 6(1)(a) GDPR in connection with the provisions of the Polish law on provision of electronic services and telecommunications law);
  12. for analytical, statistical or advertising purposes in connection with the use of cookies or similar technologies - the legal basis for processing is your consent (Article 6(1)(a) GDPR).

Do you have to provide your personal data?

Providing your personal data is in principle voluntary, but without it we will not be able to fulfill the above mentioned purposes, e.g., you will not be able to register your Account or use most of the Services. When you contact us or make a complaint, providing personal data is voluntary, but necessary in order to properly resolve the matter or answer the question and process the complaint. In the case of sending you Notifications and Newsletter, providing your email address is voluntary, but necessary for you to receive such communication from us.

In order to send you an invoice, we may require you to provide data necessary according to the relevant law.

How long do we store your data?

We keep your personal data for as long as necessary for the purposes for which we originally collected it or to comply with other legal requirements.

The data is kept for the time we provide Services to you. If you request us to delete your Account and discontinue the Services, your Account and all data entered by you will be deleted without undue delay, except for the data that the Service Provider is obliged to keep in accordance with generally applicable laws for the time indicated therein.

We store payment data in accordance with the periods indicated in tax and accounting laws. Currently, according to Polish law, this period is 5 years, counting from the end of the year in which the transaction was made.

Selected personal data may be processed by us after the aforementioned time for the purpose of establishing, asserting or defending against possible claims, for the period resulting from the statute of limitations for such claims.

Personal data that we process on the basis of your consent will be stored at most until you withdraw your consent to the processing of personal data.

Can we disclose your personal data?

Sometimes, in order to provide Services to you, we need external entities to support us and perform services for us. Accordingly, the recipients of your personal data may be (not limited to) entities providing us support and assisting us with sales, marketing and communication initiatives, IT or hosting services, payment processors, consulting and accounting service providers, identity authentication and information technology service providers and other entities to the extent necessary for the purposes of data processing. Business partners and service providers are required by contract to keep the information received on behalf of us confidential and secure and not use it for any purpose other than the purpose for which it was provided to them.

In addition, from the nature of the Services provided, the documents you add in the Application that may contain personal information may be sent to persons or companies you designate.

In connection with our use of third-party service providers or use of cookies or similar technologies, your data may be transferred to entities outside the European Economic Area, but only if the requirements of Chapter V of the GDPR are met (e.g., based on a European Commission decision on the adequacy of safeguards in a particular country, or based on standard contractual clauses). We may also share your data in cases required by law, and in order to establish, exercise or defend our rights.

Our use of cookies or similar technologies
